1. Eligibility: The Rubio’s Coastal Grill Rubio’s Adventure Giveaway (the “Promotion”) is open only to legal residents of Arizona, California, and Nevada, who are at least eighteen (18) years old at the time of entry. Employees of Rubio’s Restaurants, Inc. (“Sponsor” and “Rubio’s”), Warner Bros. Home Entertainment Inc., Red Door Interactive, The Regan Group (“TRG”) and its franchisees, and their parent and affiliate companies, suppliers as well as the immediate family (spouse, parents, siblings, and children) and household members of each such employee are not eligible to participate in Sweepstakes or receive a prize. The Promotion is subject to all applicable federal, state, and local laws and regulations and is void outside the listed states and where prohibited. Participation constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor’s and Administrator’s decisions, which are final and binding in all matters related to the Promotion. Winning a prize is contingent upon fulfilling all requirements set forth herein.

3. Timing: The Promotion begins on September 23, 2022 at 12:01 a.m. Pacific Daylight Time (“PT”) and ends on September 30, 2022 at 11:59 p.m. PT (the “Promotion Period”). Administrator’s computer is the official time-keeping device for this Promotion.

If you don’t already have an Instagram account, go to the respective websites, and create an account. Creating an account is free. If an entrant is not the age of majority in the jurisdiction in which entrant resides (“Minor”), entrant will need to obtain permission from his/her parent/legal guardian in order to enter. Normal time, toll, connection, and usage rates, if any, charged by your service provider will apply. Use of script, macro, or other automated systems to participate is prohibited and will result in disqualification. In the event of a dispute as to the identity of an entrant, the authorized account holder will be deemed to be the proper entrant. The “authorized account holder” is the natural person assigned an Instagram account. The potential winner may be required to show proof of being the authorized account holder. PLEASE NOTE THAT A HIGH VOLUME OF ENTRIES OR TECHNICAL DIFFICULTIES WITH THE SYSTEMS MAY RESULT IN TEMPORARY INABILITY TO ENTER THE SWEEPSTAKES SUCH THAT YOUR ENTRY IS NOT RECEIVED IN TIME TO PARTICIPATE. SPONSOR IS NOT RESPONSIBLE OR LIABLE SHOULD ANY ENTRIES NOT BE RECEIVED DUE TO SUCH DELAYS OR TECHNICAL DIFFICULTIES.

5. Drawing: Five (5) Potential winners (one (1) Grand Prize and Four (4) Secondary Prizes) will be chosen at random from all eligible entries received during the Promotional Period. The drawing will occur on or about October 7, 2022. Winner will be notified by direct message on Instagram by Sponsor within approximately two (2) days of the drawing.

Odds of winning are dependent on the number of Entries received during the Sweepstakes Period.

All federal, state and local taxes are the sole responsibility of the Winners. Prize is non-transferable and cannot be substituted except by Sponsor for a prize of equal or greater value in its discretion. In the event a Prize Winner is a Minor, his or her parent or legal guardian must provide permission for the potential winner to receive the prize.

7. Winner Notification: Sponsor will notify potential Winner on or about October 15, 2022 via Instagram direct message. If a potential winner does not reply within two (2) days, or is deemed ineligible in Sponsor’s sole discretion, the prize will be forfeited. In the event that a potential winner is disqualified for any reason, or a prize comes back as undeliverable, Sponsor will award the applicable prize to an alternate winner from among all remaining eligible entries. In Sponsor’s discretion only three (3) alternate drawings will be held, after which the applicable prize will remain unawarded. The Sponsor reserves the right to modify the notification procedures in connection with the selection of an alternate winner, if any. Potential winners are subject to verification by Sponsor whose decisions are final and binding in all matters relating to this Sweepstakes. An Entrant is not a winner of any prize regardless of notification unless and until Entrant’s eligibility is verified. By entering this Sweepstakes, unless prohibited by law, each Entrant grants to the Sweepstakes Entities the right to use, display, distribute or publish such Entrant’s name, likeness, photograph, voice, address (city and state), biographical information, and any material based thereon or derived therefrom, and his/her Entry or to refrain from so doing, in any manner in any and all media, whether now known or hereafter devised, anywhere in the world in perpetuity without limitation or compensation and without additional notice. License: By entering you grant Sweepstakes Entities a non-exclusive, non-revocable, perpetual, worldwide license to publish, reproduce, distribute, display, exhibit, transmit, and otherwise use, and permit others to use your Entry in any manner, form, or format now or hereinafter created, including on the internet, and for any purpose, including, but not limited to, advertising or promotion of Sweepstakes Entities and Sweepstakes Entities’ goods and/or services, all without further consent from or payment to you. Sponsor reserves the right to post any Entry on the Sponsor’s website but Sponsor has no obligation to post or publish to do so and it has no effect on the Sweepstakes. In addition, Entrants acknowledge that Sweepstakes Entities do not waive any rights to use similar or related ideas that might be contained in a Tweet which was previously known to Sponsor, or developed by their employees, or obtained from sources other than Entrant, or rights to use similar or related ideas without any restriction whatsoever, or further obligation to Entrants.
9. General Conditions: This Sweepstakes is intended participants in AZ, CA and NV only and shall only be construed and evaluated according to the laws of those states and federal law. You are not authorized to participate in the Sweepstakes if you are not located within AZ, CA or NV. By participating, Entrants (and their parents or legal guardians if Entrants are Minors) agree (a) to be bound by these Official Rules and the decisions of the Sponsor and the judges, which shall be final in all respects, (b) agree that they are bound by the Terms of Service of Instagram regarding the posting, (c) agree that any dispute arising under this Sweepstakes will be governed by, and construed in accordance with, the laws of the State of California, United States of America, without giving effect to any choice of law or conflict of law rules, (d) consent to the jurisdiction and venue of the federal, state, and local courts located in San Diego, CA, and (e) hereby release the Sweepstakes Entities (including Rubio’s Restaurants Inc. and Warner Bros. Home Entertainment Inc.), Instagram, each of their respective officers, directors, agents, representatives and employees; and each of these companies and individuals’ respective successors, representatives and assigns (collectively, the “Released Parties“) from any and all actions, claims, injury, loss or damage arising in any manner, directly or indirectly, from or in connection with participation in this Sweepstakes and/or acceptance or use of any awarded prize. Entrants agree to indemnify and hold the Released Parties harmless from and against any claims arising out of a breach by Entrant of any of the representation and warranties contained in these Official Rules. Sponsors disclaim any liability for damage to any computer system resulting from participating in or accessing or downloading information in connection with this Sweepstakes, and reserve the right, in their sole discretion, to cancel, modify or suspend the Sweepstakes should a virus, bug, computer problem, unauthorized intervention, human error or other error, corrupt the administration or security of the Sweepstakes. Sponsors shall not be responsible if the Sweepstakes cannot be implemented or if a prize cannot be awarded due to delays or interruptions due to acts of God, acts of war, civil disturbance, strikes, governmental action, natural disasters, weather or acts of terrorism. Any and all disputes, claims, and causes of action arising out of or in connection with this Sweepstakes, shall be resolved individually, without resort to any form of class action. ANY CLAIMS, JUDGMENTS AND/OR AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS ASSOCIATED WITH ENTERING THIS SWEEPSTAKES. ENTRANT (AND THEIR PARENTS OR LEGAL GUARDIANS IF ENTRANTS ARE MINORS) HEREBY WAIVE ANY RIGHTS OR CLAIMS TO ATTORNEY’S FEES, INDIRECT, SPECIAL, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ENTRANT, IDENTIFIABLE PERSONS, OR THIRD-PARTY PARTICIPANTS, WHETHER FORESEEABLE OR NOT AND WHETHER BASED ON NEGLIGENCE OR OTHERWISE. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE SWEEPSTAKES WEB SITES OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND WILL RESULT IN DISQUALIFICATION FROM PARTICIPATION IN THE SWEEPSTAKES. SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSORS RESERVE THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY FEES) TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.

Privacy Policy: Any personal information supplied by you when entering this Sweepstakes will be subject to the Sweepstakes Entities’ privacy policy posted on https://rubios.com/privacy and the privacy policy of Instagram can be found on respective website. In addition, unless prohibited by the applicable privacy policy or by law, by entering the Sweepstakes, you grant the Sweepstakes Entities permission to share your email address and any other personally identifiable information with select business partners for you to receive offers from those partners and with the other Sweepstakes Entities, and any other organizations affiliated with the sponsorship, fulfillment, administration, prize support, advertisement or promotion of the Sweepstakes, for the purpose of administration, judging and prize fulfillment.
